Welcome to Decade Young (decadeyoung.com), a property of Vital Health, a product of Gigploy, LLC ("Vital Health," "we," "us," or "our"). These Terms and Conditions ("Terms") govern your use of the Site and the Future Self experience (together, the "Service"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be a resident of the United States and at least 18 years old to use the Service. By using the Service, you represent that you meet these requirements. The Service is not directed to individuals in the European Union or European Economic Area.

2. What the Service is

The Future Self experience lets you upload a photograph and receive an AI-generated image that visualizes a future self, along with information based on your quiz responses.

The Service is for entertainment and educational purposes only. It is not medical advice. It does not provide medical services, diagnosis, treatment, or recommendations, and it is not a substitute for consultation with a qualified healthcare provider. Decisions about your health should be made with a licensed professional who knows your situation.

The generated image is an artistic and inspirational visualization. It is not a prediction, a medical projection, or a representation of any actual future outcome.

3. Your photograph and content

When you upload a photograph, you represent and warrant that:

• The photograph is of you, or you have the right and permission to upload and use it
• You have the authority to grant the rights described in these Terms
• The photograph does not violate any law or any third party's rights

You grant us a limited license to use, store, and process your photograph solely to provide the Service, as described in our Privacy Policy. We handle your photograph as biometric information under the retention and destruction schedule set out in the Privacy Policy.

You must not upload photographs of other people without their consent, images of minors, or any unlawful, infringing, or harmful content.

4. Consent to biometric processing

The Service processes biometric information. Before you upload a photograph, you must provide written consent. Your use of the Service is subject to that consent and to our Privacy Policy, which is incorporated into these Terms by reference. Please read the Privacy Policy carefully.

5. Intellectual property

The Site and its content, including text, design, graphics, and software, are owned by Vital Health or its licensors and are protected by intellectual property laws. We grant you a limited, personal, non-commercial license to use the Service.

The image generated for you is provided for your personal, non-commercial use. You may keep, download, and share it for personal purposes. You may not use it in a way that suggests endorsement by Vital Health or in any unlawful manner.

6. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose
• Upload content you do not have the right to upload
• Interfere with, disrupt, reverse-engineer, or gain unauthorized access to the Service
• Use automated means to access the Service without our permission
• Misrepresent your identity or age

7. Third-party services

The Service relies on third-party providers, including OpenAI, Supabase, Resend, and PostHog, as described in the Privacy Policy. We are not responsible for the acts or omissions of third parties. If we connect you with a partner provider, that provider is an independent business, and any relationship you form with them is between you and them.

8. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any generated image will meet your expectations. To reiterate, the Service is for entertainment and education only and is not medical advice.

9. Limitation of liability

To the fullest extent permitted by law, Vital Health and Gigploy, LLC will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed one hundred dollars ($100) or the amount you paid us for the Service, whichever is greater.

10. Indemnification

You agree to indemnify and hold harmless Vital Health, Gigploy, LLC, and their officers, employees, and agents from any claims, damages, or expenses arising from your use of the Service, your content, or your violation of these Terms.

11. Dispute resolution and arbitration

Please read this section carefully. It affects your legal rights.

Informal resolution. Before filing any claim, you agree to contact us and attempt to resolve the dispute informally for at least 30 days.

Arbitration. If we cannot resolve a dispute informally, you and Vital Health agree to resolve it through binding individual arbitration rather than in court, except that either party may bring a qualifying claim in small claims court. Arbitration will be administered by a recognized arbitration provider under its consumer rules.

Class action waiver. You and Vital Health agree that each may bring claims only in an individual capacity, and not as a plaintiff or class member in any class, collective, or representative proceeding.

Opt-out. You may opt out of this arbitration agreement within 30 days of first accepting these Terms by contacting us at the address below.

12. Governing law

These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-law principles, except where applicable consumer-protection law of your state of residence requires otherwise.

13. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date and post the new version. Your continued use of the Service after changes take effect means you accept the updated Terms.
